1. Agreement to Terms

By accessing or using Eros ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the effective date above. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.

2. Eligibility

You must be at least 18 years old to use Eros. By creating an account, you confirm that you are 18 or older. We do not knowingly provide the Service to anyone under 18.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to provide accurate information during registration and to keep your account credentials secure. You are responsible for all activity that occurs under your account.

4. Description of the Service

Eros is a web-based platform that allows users to generate romantasy and romance fiction stories using artificial intelligence. The Service also allows users to chat with characters from their generated stories. The Service includes a free tier and a paid subscription tier.

Eros does not build or own the underlying AI models used to generate content. The Service uses third-party AI technology to produce stories and character interactions based on user prompts.

5. User Content

5.1 Your Prompts and Inputs

You retain ownership of the prompts, descriptions, and other inputs you provide to the Service ("User Inputs"). By submitting User Inputs, you grant Eros a non-exclusive, worldwide, royalty-free license to use, process, and store your User Inputs solely for the purpose of providing and improving the Service.

5.2 AI-Generated Content

Stories, character conversations, and other content generated by the Service ("Generated Content") are produced by third-party AI models in response to your prompts. Ownership of AI-generated content is a developing area of law that varies by jurisdiction.

Eros does not claim ownership of Generated Content. You are free to use, modify, publish, and distribute the Generated Content you create through the Service. However, Eros makes no representations or warranties regarding your legal right to copyright AI-generated material, and you are solely responsible for determining how you may use such content under applicable law.

5.3 Public Library

If you make your Generated Content available through the Eros public library, you grant Eros and other users a non-exclusive, worldwide, royalty-free license to view, read, and interact with that content within the Service. You may remove your content from the public library at any time, which will terminate this license going forward.

6. Acceptable Use

You agree not to use the Service to:

Generate content that sexually exploits or endangers minors in any way.
Generate content that constitutes or promotes real-world violence, terrorism, or threats against specific individuals.
Harass, stalk, or intimidate any person.
Impersonate another person or entity in a misleading or harmful way.
Attempt to reverse-engineer, extract, or access the underlying AI models, algorithms, or systems used by the Service.
Use automated tools, bots, or scripts to access the Service in a manner that exceeds reasonable use or disrupts the Service for others.
Violate any applicable law or regulation.

We reserve the right to remove content and suspend or terminate accounts that violate these terms, at our sole discretion.

7. Subscriptions and Billing

7.1 Free Tier

The Scribe (free) plan provides limited access to the Service as described on the pricing page. We may change the features or limits of the free plan at any time.

7.2 Paid Subscriptions

The Shadow Master plan is a paid monthly subscription. By subscribing, you authorize us to charge your payment method on a recurring monthly basis until you cancel.

7.3 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until that period ends. We do not provide refunds for partial billing periods.

7.4 Price Changes

We may change subscription prices with at least 30 days' notice. Price changes will take effect at the start of your next billing period following the notice. If you do not agree with a price change, you may cancel your subscription before the new price takes effect.

8. Intellectual Property

The Eros name, logo, website design, and original content created by Eros (excluding User Inputs and Generated Content) are the property of Eros Red and are protected by applicable intellectual property laws. You may not use our branding or original content without our written permission.

9. Third-Party Services

The Service relies on third-party AI providers and other third-party services to function. We are not responsible for the availability, accuracy, or performance of third-party services. Changes to third-party services may affect the features, quality, or availability of the Service.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

AI-GENERATED CONTENT MAY CONTAIN ERRORS, INCONSISTENCIES, OR MATERIAL THAT IS OFFENSIVE, INAPPROPRIATE, OR FACTUALLY INCORRECT. YOU USE GENERATED CONTENT AT YOUR OWN RISK.

EROS DOES NOT PROVIDE LEGAL ADVICE REGARDING THE OWNERSHIP, COPYRIGHTABILITY, OR PERMISSIBLE USE OF AI-GENERATED CONTENT. CONSULT A QUALIFIED ATTORNEY FOR GUIDANCE ON THESE MATTERS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EROS RED AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify and hold harmless Eros Red and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Termination

We may suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Sections 5, 10, 11, 12, and 14 survive termination.

14. Governing Law and Disputes

These Terms are governed by the laws of Texas, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in Austin, except that either party may seek injunctive relief in a court of competent jurisdiction. You agree to waive any right to a jury trial or to participate in a class action.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be modified to the minimum extent necessary to make it enforceable, or removed if modification is not possible. The remaining provisions will continue in full effect.

16. Entire Agreement

These Terms, together with our Privacy Policy www.eros.red/privacy, constitute the entire agreement between you and Eros Red regarding the Service and supersede all prior agreements.
